Welcome to Lumtrk ("the Service"), operated by Lanzhou Western Hammer Technology Co., Ltd. (兰州市西域大锤科技有限公司, "we", "us", or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you and us governing your access to and use of Lumtrk.

Please read these Terms carefully before accessing or using the Service, especially the disclaimers, limitations of liability, and dispute resolution provisions. By signing in, creating an account, or using the Service in any way, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to all terms and conditions, you must not use or access the Service.

1. Definitions

Unless expressly defined otherwise, the following terms have the meanings set forth below:

  • The Service: refers to the Lumtrk website (lumtrk.com), mobile applications, heatmap rendering engine, and backend services that provide personal fitness activity import, deduplication, parsing, and 2D/3D heatmap visualization;
  • User: any individual who registers, signs in, or uses the Service (also referred to as "you");
  • Third-Party Data Sources: third-party fitness platforms or device providers authorized by you (such as Garmin Connect, Intervals.icu, etc.);
  • Activity Data: workout logs, GPS tracks, activity timestamps, sport types, and performance metrics (e.g. pace, heart rate, elevation) returned by third-party data sources upon your explicit authorization;
  • Activity Heatmap: private visual representations generated by parsing and aggregating your authorized GPS tracks, rendered in 2D flat or 3D illuminated ribbon styles on map layers;

2. Scope and Modifications

These Terms apply to all features and pages of the Service. We reserve the right to revise these Terms within the boundaries of applicable law:

  • Revisions: We may update these Terms to reflect changes in our service offerings, legal regulations, or operational practices. The revised Terms will be posted on this page with an updated effective date;
  • Material Notices: If modifications constitute a material change to your rights or obligations, we will notify you through prominent in-app prompts, sign-in banners, or email;
  • Continued Use: Your continued use of the Service after changes take effect constitutes your binding acceptance of the updated Terms. If you do not agree, you must cease using the Service or delete your account.

3. Account Registration and Management

To unlock full activity import and heatmap capabilities, you need to manage your Lumtrk account:

  • Age Requirement: You must be at least 18 years old, or at least 14 years old with the guidance and consent of a parent or legal guardian, to register and use the Service;
  • Authentication: We use Logto for identity management, supporting email and social logins. You agree to provide true and accurate information and shall not impersonate others;
  • Account Security: You are solely responsible for safeguarding your credentials and for all activities that occur under your account. You shall not lend, transfer, or resell your account to third parties;
  • Account Deletion: You can permanently delete your account at any time in the Account Center. Upon deletion, your personal information, authorization tokens, historical tracks, and heatmap data will be irreversibly erased in accordance with our Privacy Policy.

4. Service Scope and Specific Conditions

Lumtrk is dedicated to providing high-performance personal activity heatmaps for runners, cyclists, and outdoor enthusiasts:

  • Core Capabilities: With your explicit authorization, we unidirectionally import activities from supported data sources, perform cross-source deduplication and route parsing, and build private 2D/3D heatmaps exclusively visible to your authenticated account;
  • Data Source Authorization: You connect third-party platforms via their official authorization protocols (e.g. OAuth). We store access tokens encrypted on the server side and never access or store your third-party account passwords. You can disconnect or revoke access at any time in settings or directly on the third-party platform;
  • Visual Representation: The height and luminance of 3D heatmaps indicate route repetition frequency and accumulated effort, not physical topographical elevation. Infrequently visited paths remain gentle ribbons, while repeatedly traversed routes rise prominently;
  • Non-Navigation Disclaimer: Heatmaps and GPS tracks are subject to satellite signal drift, urban canyon interference, hardware discrepancies, and basemap tolerances. The Service is designed strictly for personal review and visual reflection. It MUST NOT be used for off-road navigation, emergency search and rescue, precision positioning, or life-critical decisions;
  • No AI Features: Lumtrk does not provide AI coaching, automated training plans, or medical advice. We strictly prohibit sending your personal workout tracks to third-party AI model providers or using your data to train machine learning models;
  • Service Availability: Map rendering and high-performance 3D tiles depend on device WebGL2 capabilities and network performance. While we strive for optimal uptime, we do not guarantee uninterrupted or error-free operation at all times.
  • Pro subscription: Free displays all GPS activities from the last 6 calendar months, with no limit on the number of activities; Pro displays the full saved history. Importing, syncing and saving data have no membership limit. Paddle sells Pro as a monthly or annual recurring subscription with a 7-day free trial that requires payment details. Unless canceled before the trial ends, billing begins at the price, currency, tax and date shown at checkout. Renewal, cancellation and refund requests are described at https://lumtrk.com/refund.

5. User Conduct and Restrictions

To protect system stability and ensure equal access for all users, you agree not to engage in any of the following prohibited activities:

  • Automated Scraping and Abuse: You shall not use any script, bot, spider, scraper, or unauthorized automated tools to crawl, probe, or make excessive automated requests to our API endpoints;
  • Reverse Engineering: You shall not reverse engineer, decompile, disassemble, sniff, or circumvent any encryption, communications protocols, or heatmap tile data formats of the Service;
  • Attacks and Resource Exhaustion: You shall not launch denial-of-service (DDoS) attacks, concurrent stress tests, or consume server computing, networking, or storage resources beyond normal personal use;
  • Unauthorized Commercialization: You shall not capture, redistribute, resell, or sublicense the Service's data, maps, or backend capabilities without our explicit prior written consent;
  • Enforcement: If any violation is detected, we reserve the right to immediately throttle, block IP addresses, terminate accounts, and purge unauthorized data without prior notice, and to pursue full civil damages and legal remedies.

6. Intellectual Property

All intellectual property rights associated with the Service are protected by applicable laws and international treaties:

  • Ownership: The Lumtrk brand name, logos, visual UI designs, source code, heatmap rendering and shader algorithms, and database designs belong exclusively to Lanzhou Western Hammer Technology Co., Ltd.;
  • User Data Ownership: You retain full ownership of the original activity tracks and GPS records you provide. You grant us a non-exclusive, worldwide, royalty-free license to parse, process, and render this data solely as necessary to operate the Service for you;
  • Restrictions: You may not duplicate, imitate, create derivative works from, or reverse engineer any aspect of Lumtrk without our prior written authorization.

7. Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, you agree to the following disclaimers and liability limitations:

  • "As-Is" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including fitness for a particular purpose or continuous availability;
  • Third-Party Platforms: We are not liable for import failures, delays, or outages caused by changes to third-party APIs, credential expiration, or platform downtime;
  • Assumption of Physical Risk: Sports and outdoor activities inherently carry physical risks. You should exercise safely according to your personal fitness level, medical advice, and environmental conditions. We assume no responsibility for any injury, accident, or damage resulting from your physical activities or reliance on the heatmap;
  • Limitation of Liability: In no event shall our total aggregate liability for all claims arising out of or relating to the Service exceed the amount actually paid by you to Lumtrk in the twelve (12) months preceding the event giving rise to liability (or RMB 0 if you used the Service free of charge).

8. Privacy and Data Protection

We take your privacy and personal data seriously. For details regarding how we collect, process, encrypt, and retain your activity data and account credentials, please refer to our Privacy Policy:

  • Our Privacy Policy forms an integral part of these Terms. Any matters regarding personal data not specified herein shall be governed by the Privacy Policy.

9. Termination and Dispute Resolution

Provisions governing agreement termination and dispute settlement:

  • Termination: These Terms terminate upon account deletion or if we terminate your account due to a material breach. Provisions regarding IP ownership, disclaimers, limitations of liability, and governing law shall survive termination;
  • Governing Law: The conclusion, validity, interpretation, and enforcement of these Terms shall be governed by the laws of the People's Republic of China;
  • Dispute Jurisdiction: Any dispute arising from or in connection with these Terms shall first be resolved through friendly consultation. If consultation fails, either party may file a lawsuit with the People's Court of competent jurisdiction where Lanzhou Western Hammer Technology Co., Ltd. is located.

欢迎使用 Lumtrk（以下简称“本服务”）。本服务由兰州市西域大锤科技有限公司（以下简称“我们”）提供。本使用条款（以下简称“本协议”）是您与我们之间就注册、登录、访问及使用 Lumtrk 所订立的法律协议。

使用本服务前，请您仔细阅读本协议全部内容，特别是免责声明、权利限制及争议解决条款。当您注册账户、登录或以任何方式使用本服务时，即表示您已充分阅读、理解并同意接受本协议的全部约束。如果您不同意本协议的任何条款，请停止访问并勿使用本服务。

1. 定义

除非本协议另有明确约定，下列术语具有以下含义：

  • 本服务：指 Lumtrk 网站（lumtrk.com）、移动客户端、热图渲染引擎及后端服务所提供的个人运动轨迹导入、去重、解析及 2D/3D 热图可视化展示功能；
  • 用户：指注册、登录或使用本服务的自然人（以下亦称“您”）；
  • 第三方数据源：指由您授权连接的第三方运动平台或设备服务商（如 Garmin Connect、Intervals.icu 等）；
  • 运动数据：指经您明确授权后由第三方数据源返回的运动活动记录、GPS 轨迹、运动时间、运动类型及文件中包含的相关指标（如配速、心率、海拔等）；
  • 运动热图：指将您授权提供的运动轨迹解析、聚合后以 2D 平面或 3D 立体光带形式在地图图层中呈现的私密可视化图景。

2. 适用范围与协议变更

本协议适用于本服务所涵盖的所有功能与页面。我们保留在法律允许的范围内适时修订本协议的权利：

  • 条款修订：当业务调整、法律法规变化或服务功能升级时，我们可能会更新本协议。更新后的协议将在网站公布并刷新生效日期；
  • 重要通知：如变更涉及核心权利义务的实质性调整，我们将通过站内提示、登录提示或邮件等合理方式告知；
  • 持续生效：若您在修订条款生效后继续使用本服务，即视为您已接受修改后的协议内容。如不同意修改，您可随时停止使用或申请注销账户。

3. 账户注册与管理

为了完整使用 Lumtrk 的轨迹导入与热图渲染能力，您需要创建并管理账户：

  • 年龄要求：您须年满 18 周岁，或已满 14 周岁并在监护人指导和同意下注册与使用本服务；
  • 账户登录：我们使用 Logto 提供统一身份认证，支持邮箱或第三方社交账户关联。您承诺提供真实、有效的账户信息，不得冒用他人身份；
  • 安全保管：您应妥善保管自身的登录凭据，不得将账户出借、赠与、出租或转让给他人。通过您的凭据所进行的所有操作均视为您本人的行为；
  • 账户注销：您可随时在“账号中心”发起永久注销。注销生效后，我们将依据《隐私政策》彻底删除您的个人信息、绑定凭据、历史轨迹与热图数据，且该操作不可撤销。

4. 服务内容与特别说明

Lumtrk 为热爱运动与记录生活的跑者、骑行者及户外爱好者提供专注的个人运动热图服务：

  • 核心功能：在您主动授权后，从支持的数据源单向导入运动活动，执行跨来源去重与轨迹解析，生成专属于您账户的 2D/3D 热图与足迹全景；
  • 第三方数据源授权：连接第三方平台时，您通过其官方授权流程授予访问权限。我们使用行业标准的加密手段在服务端存储凭据，不获取您的第三方账户登录密码。您可随时在数据源设置中解除连接，或在第三方平台撤销授权；
  • 热图视觉表现：3D 热图的高度与发光表示局部路线的重复经过程度与坚持轨迹，不代表地表实际物理海拔。偶尔经过的路段轻轻铺开，反复跑过的路段升起立体光带；
  • 非导航用途免责：运动轨迹与热图渲染受 GPS 信号漂移、卫星遮蔽、运动手表算法差异及底图精度等客观因素影响，热图展示仅供个人复盘与艺术回顾，严禁用于户外定向越野、应急救援、精准导航或任何与人身生命安全相关的决策；
  • 无 AI 辅助说明：Lumtrk 当前不提供 AI 运动教练、生成式训练计划或健康诊断功能。我们绝不将您的个人轨迹用于任何 AI 或机器学习模型的训练或评估；
  • 服务稳定性：部分数据源、底图图层或高性能 3D 渲染可能受网络环境、浏览器硬件加速（WebGL2）支持度或第三方 API 状态限制，我们努力保障服务可用性，但不保证服务无偶发中断或延迟。
  • Pro 订阅：Free 展示最近 6 个自然月内全部 GPS 活动，不限制活动数量；Pro 展示全部已保存历史。导入、同步和保存不受会员限制。Paddle 以月付或年付自动续费方式销售 Pro，提供需要填写付款信息的 7 天免费试用；如未在试用结束前取消，将按结账页显示的价格、币种、税费和日期开始收费。续费、取消及退款申请详见 https://lumtrk.com/refund。

5. 用户行为规范

为保障所有用户的正常使用及系统的安全稳定，您在使用本服务时承诺严格遵守以下规范，严禁从事下列行为：

  • 自动化抓取与滥用：严禁使用脚本、机器人、爬虫、自动化程序或未经授权的第三方工具高频调用、模拟请求或探测本服务的 API 接口；
  • 协议逆向与反编译：严禁通过逆向工程、反编译、抓包破解、伪造请求凭证等手段破解或滥用本服务的通信协议、热图瓦片数据或加密机制；
  • 系统攻击与资源消耗：严禁发起拒绝服务攻击（DDoS）、恶意并发压测、构造非法请求包，或以任何超出自然人正常运动记录需求的方式恶意消耗网络、计算与存储资源；
  • 非法商业化转售：未经我们明确书面许可，严禁抓取、转存、转售本服务的热图成果、技术接口或将系统能力打包提供给商业实体；
  • 违规处理：一旦发现上述违规行为，我们有权在不事先通知的情况下采取即时限制访问、阻断 IP、封禁账户、清空违规数据等措施，并保留通过法律途径追究侵权人全部民事赔偿（包括但不限于排查成本、服务器损失及合理维权费用）与刑事责任的权利。

6. 知识产权

本服务的全部智力成果均受中华人民共和国法律及国际公约的保护：

  • 知识产权归属：Lumtrk 的产品名称、商标、标志（Logo）、UI 视觉设计、网页代码、热图渲染与着色算法及数据库架构等知识产权均归兰州市西域大锤科技有限公司所有；
  • 用户数据权属：您上传或授权导入的原始运动轨迹的所有权归属于您本人。在向您提供服务所必需的范围内，您授予我们对该运动数据进行去重、解析、聚合计算并生成热图的非排他、全球范围内免费的使用许可；
  • 禁止侵权：未经我们事先书面授权，任何组织或个人不得以任何方式复制、模仿、反向工程、建立镜像站点或用于衍生商业产品的开发。

7. 免责声明与责任限制

在适用法律允许的最大范围内，您理解并同意以下免责声明与责任限制条款：

  • 按现状提供：本服务按“现状”（AS IS）和“可获得”的基础提供。我们不对服务的及时性、完全无误、不发生网络中断、以及数据百分之百完整性提供任何明示或暗示的担保；
  • 第三方平台责任：因第三方数据源接口变更、策略下线、网络抖动或您的第三方凭据失效而导致的导入中断或延迟，我们不承担间接损失赔偿责任；
  • 运动风险自负：运动本身具有客观的人身健康与安全风险。您应根据自身的健康状况、专业医生建议及实际天气环境科学开展运动。依赖本服务热图而引发的任何意外、伤害或损失，本服务均不承担责任；
  • 赔偿上限：在任何情况下，我们对您因使用或无法使用本服务所遭受的全部索赔与损失的赔偿总额，上限不超过您在导致索赔的事件发生前十二（12）个月内向 Lumtrk 实际支付的费用总额（若本服务为免费使用，则赔偿上限为人民币零元）。

8. 隐私与个人信息保护

我们高度重视您的隐私与个人信息安全。关于我们如何收集、使用、加密存储及保护您的运动数据与账户信息，请参阅《隐私政策》：

  • 《隐私政策》与本协议共同构成您使用本服务的完整法律准则。本协议未尽之个人信息保护事宜，均以《隐私政策》的专门约定为准。

9. 协议终止与争议解决

本协议的终止条件及争议解决方式如下：

  • 协议终止：您注销账户、停止使用服务，或因严重违反本协议被我们终止账户时，本协议相应终止。终止后，免责声明、知识产权、责任限制及管辖条款继续有效；
  • 适用法律：本协议的订立、执行、解释及争议管辖均适用中华人民共和国大陆地区法律；
  • 争议管辖：若双方发生任何因本协议或本服务引起的争议，应首先本着友好诚信的原则协商解决；协商不成的，任何一方均有权向兰州市西域大锤科技有限公司住所地有管辖权的人民法院提起诉讼。
